If you've ever been told your project needs a "Performance Solution," you've probably had one of two reactions.
The first is confusion.
The second is concern.
For many homeowners, builders and even some designers, the phrase sounds like something has gone wrong. It sounds expensive. It sounds complicated. It sounds like your building doesn't comply with the National Construction Code (NCC).
In reality, none of those assumptions are necessarily true.
At Enclave Architects, we're often involved in projects where a building surveyor requests a Performance Solution. Sometimes it's for accessibility. Sometimes it's energy efficiency. Sometimes it's waterproofing, fire safety, stair design, smoke management or another technical aspect of the building.
One of the first things we explain to clients is this:
A Performance Solution isn't an exception to the rules. It is one of the rules.
It's a legitimate compliance pathway built into the National Construction Code itself. In fact, Australia's building regulations have been written around performance-based principles for decades because no set of prescriptive rules can anticipate every building, every site or every innovation.
Understanding that single point changes the entire conversation.

The National Construction Code Doesn't Tell You How to Build
This surprises many people.
Most assume the NCC is simply a giant instruction manual.
It isn't.
The Code doesn't exist to tell you exactly how every building must be constructed.
Its purpose is much broader.
The NCC establishes Performance Requirements.
In other words, it defines what a building must achieve, rather than insisting there is only one acceptable way to achieve it.
For example, the Code might require a building to:
provide adequate fire safety;
prevent water entering the building;
provide safe access;
achieve minimum energy efficiency;
protect occupants from structural failure.

These are outcomes.
They're not construction methods.
The Code is primarily concerned with performance, not prescription.
Two Different Paths to Compliance
Once people understand this, the next concept becomes much easier.
There are two recognised pathways for demonstrating compliance with the NCC.
1. Deemed-to-Satisfy (DTS)
This is the pathway most people know.
The NCC contains hundreds of detailed provisions covering things like:
stair dimensions
insulation levels
waterproofing systems
window performance
balustrade heights
wall construction
ventilation
structural requirements
If your project follows those provisions exactly, you're using the Deemed-to-Satisfy pathway.
It's straightforward.
It's predictable.
And for many projects, it's entirely appropriate.
2. Performance Solution
The second pathway is different.
Instead of following the prescribed solution, the design team demonstrates that an alternative solution still satisfies the relevant Performance Requirements of the Code.
Importantly, a Performance Solution is not a lesser standard.
The required level of performance doesn't change.
Only the method of demonstrating compliance changes.
Think of It Like Following a Recipe
One analogy we often use with clients is cooking.
Imagine you're baking a cake.
A recipe tells you:
exactly which ingredients to use;
how much of each ingredient;
what order to mix them;
what temperature to bake at.
If you follow the recipe exactly, you'll probably produce a good cake.
That's Deemed-to-Satisfy.
Now imagine you're an experienced chef.
You substitute ingredients.
You adjust quantities.
You change the cooking method.
The recipe is different.
But the finished cake is just as good—or perhaps even better.
That's a Performance Solution.
The outcome is what matters.
Not whether you followed the original recipe word for word.
Why Performance Solutions Exist
Buildings aren't all the same.
Sites aren't all the same.
Technology certainly isn't standing still.
If building regulations only allowed one prescribed construction method forever, innovation would stop almost immediately.
New materials couldn't be adopted.
New technologies couldn't be used.
Creative architectural responses would disappear.
Performance Solutions allow innovation while maintaining the same minimum standards for health, safety, accessibility and amenity.
They're one of the reasons modern Australian architecture has been able to evolve rather than remain locked in construction methods from decades ago.
Why Is My Building Surveyor Asking for One?
This is probably the question we hear most.
The answer is usually much simpler than people expect.
At some point during the design review, the building surveyor has identified that part of the proposal doesn't comply with one or more Deemed-to-Satisfy provisions.
That doesn't automatically mean the design is unacceptable.
It simply means the surveyor can't approve it through the DTS pathway.
Instead, they need evidence demonstrating that the alternative design still satisfies the relevant Performance Requirements before issuing the building approval.
In other words:
The surveyor isn't asking you to redesign the building.
They're asking you to demonstrate compliance in a different way.
Common Examples
Many people assume Performance Solutions are only used for large commercial buildings.
They're not.
Even residential projects occasionally require them.
Some examples include:
Accessibility
Perhaps an existing building cannot physically accommodate every prescriptive dimension required by the NCC.
Instead of abandoning the project, an accessibility consultant may develop a Performance Solution demonstrating equivalent access.
Fire Safety
This is probably the most common application.
Fire engineers regularly develop Performance Solutions where buildings contain:
atriums
large open spaces
unusual layouts
heritage constraints
alternative smoke control systems
Rather than following every prescriptive fire provision, engineering analysis demonstrates that the required level of fire safety is still achieved.
Waterproofing
Imagine a balcony where the standard falls cannot be achieved because of structural constraints.
Does that automatically mean the balcony cannot be waterproof?
Not necessarily.
A Performance Solution may demonstrate that an alternative drainage strategy, waterproofing system and detailing achieves the same outcome.
Again, the question isn't:
"Did we build it exactly as prescribed?"
The question is:
"Will it perform as required?"
Energy Efficiency
New products appear every year.
Glazing systems.
Wall systems.
Insulation products.
Building services.
Sometimes these don't fit neatly within the Deemed-to-Satisfy provisions.
Performance modelling can demonstrate that the building still achieves the required energy performance—even though the construction differs from the prescriptive approach.
Performance Solutions Are Evidence-Based
This is another common misconception.
Some people imagine a Performance Solution is simply a consultant writing a letter saying,
"We think it'll be okay."
That isn't how it works.
Performance Solutions are typically supported by one or more recognised assessment methods.
Depending on the issue, this may involve:
engineering calculations;
computer modelling;
comparison with Deemed-to-Satisfy provisions;
testing;
published research;
expert judgement;
evidence of suitability.
The level of analysis depends entirely on the complexity of the issue.
The Performance-Based Design Brief (PBDB)
One of the biggest changes in recent years has been the formalisation of the Performance Solution process.
Before detailed analysis begins, the project team usually prepares a Performance-Based Design Brief, commonly called a PBDB.
Think of it as the project's roadmap.
Rather than immediately jumping into engineering calculations, everyone first agrees on:
what issue is being addressed;
which Performance Requirements apply;
how compliance will be assessed;
who is responsible for each aspect of the assessment;
what evidence will be produced.
Only after this framework has been agreed does the technical assessment proceed. The NCC now requires a structured process that includes the PBDB, analysis, evaluation and a final report for Performance Solutions.
Why So Many Consultants Sign the PBDB
Clients often notice something curious.
The PBDB may contain signatures from:
the architect;
the building surveyor;
structural engineer;
fire engineer;
accessibility consultant;
hydraulic engineer;
mechanical engineer;
other specialists.
Does that mean every consultant accepts responsibility for every aspect of the Performance Solution?
No.
Each consultant is confirming their participation in developing the agreed process within their area of expertise.
The structural engineer isn't accepting responsibility for accessibility.
The accessibility consultant isn't taking responsibility for structural design.
The architect isn't certifying engineering calculations.
Each discipline contributes to the agreed assessment process.
Does a Performance Solution Cost More?
Sometimes.
Sometimes not.
It depends entirely on the issue.
A relatively simple Performance Solution may involve a single consultant producing a short technical report.
A complex commercial fire engineering assessment may require sophisticated computer modelling, multiple workshops and extensive documentation.
The real question isn't whether a Performance Solution costs money.
The better question is:
What's the alternative?
Sometimes redesigning an entire building to satisfy a single Deemed-to-Satisfy provision would cost far more than preparing a carefully justified Performance Solution.
Does It Mean the Building Is Less Safe?
Absolutely not.
This is perhaps the biggest misconception of all.
A compliant Performance Solution must demonstrate that the relevant Performance Requirements are achieved.
The benchmark hasn't changed.
Only the pathway to demonstrating compliance has changed.
In many cases, a well-developed Performance Solution produces a better outcome than simply following a prescriptive provision.
That's because the design is tailored specifically to the building rather than relying on a generic rule.
Performance Solutions Require Collaboration
One of the things we enjoy most about Performance Solutions is that they encourage collaboration.
Rather than working in isolation, consultants come together to solve a problem.
The architect explains the design intent.
The engineer analyses the technical implications.
The building surveyor considers regulatory compliance.
Specialist consultants contribute their expertise.
The result is often a more thoughtful building than one produced simply by following prescriptive rules.
Where Problems Arise
Performance Solutions themselves aren't usually the problem.
Poor communication is.
We've seen situations where:
consultants become involved too late;
assumptions are made without proper analysis;
the building surveyor is consulted after design decisions are locked in;
responsibilities are poorly defined.
These situations often lead to unnecessary redesigns, delays and additional costs.
The earlier the discussion begins, the smoother the process usually becomes.

No. Like any compliance pathway, it must satisfy the relevant Performance Requirements and be accepted by the building surveyor as part of the approval process.
Final Thoughts
The phrase "Performance Solution" often sounds intimidating.
In reality, it's simply another way of demonstrating compliance with Australia's building regulations.
It's not about avoiding the rules.
It's about proving—through evidence, analysis and collaboration—that a different design approach achieves the same required level of performance.
As architects, we see Performance Solutions not as obstacles, but as opportunities. They allow innovation where prescriptive rules may otherwise limit good design. They make it possible to respond to difficult sites, heritage constraints, evolving construction technologies and the unique needs of individual projects without compromising safety or compliance.
The most successful Performance Solutions don't begin with the question, "How do we get around the Code?"
They begin with a much better question:
"How do we achieve the intent of the Code in the smartest, safest and most appropriate way?"
And ultimately, that's exactly what performance-based design is intended to do.
